When providing financial services, Limited Liability Company “Asset Management Company “Collective Investment Projects” complies with the requirements of consumer protection legislation.
In accordance with part nine of Article 7 of the Law of Ukraine “On Financial Services and Financial Companies” No. 1953-IX dated December 14, 2021, as amended, a financial service provider, when providing information to a consumer, is obliged to comply with consumer protection legislation.
In accordance with part one of Article 4 of the Law of Ukraine “On Consumer Protection” No. 1023-XII dated May 12, 1991, as amended, consumers, when concluding, amending, executing, and terminating agreements for the receipt (purchase, order, etc.) of products, as well as when using products sold in the territory of Ukraine to satisfy their personal needs, have the right to:
- protection of their rights by the state;
- proper quality of products and services;
- product safety;
- necessary, accessible, reliable, and timely information in the state language about the product, its quantity, quality, assortment, and its manufacturer (executor, seller) in accordance with the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language”;
- service in the state language in accordance with the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language”;
- compensation for material and moral damage caused as a result of product defects, in accordance with the law;
- appeal to courts and other authorized state bodies for the protection of violated rights;
- association in public consumer organizations (consumer associations).
Products should be understood as any item (goods), work, or service that is produced, performed, or provided to meet public needs.
The consumer’s rights in case of violation of the terms of a contract for the performance of work (provision of services) are defined by Article 10 of the Law of Ukraine “On Consumer Protection”.
Consumers of financial services of LLC “AMC “Collective Investment Projects” have the right to обратиться to LLC “AMC “Collective Investment Projects”, and the Company is obliged to consider such обращения within the established timeframe.
Consumer complaints are reviewed by LLC “AMC “Collective Investment Projects” in accordance with the procedure and time limits provided by the current legislation of Ukraine. Based on the results of the review, the Company sends a response to the Consumer in the same manner in which the complaint was received. The response contains information on whether the Consumer’s claims are satisfied or rejected (either fully or partially).
In accordance with part three of Article 5 of the Law of Ukraine “On Consumer Protection”, consumer protection is carried out by the central executive body that forms and ensures the implementation of state policy in the field of consumer protection, the central executive body that implements state policy in the field of state control over compliance with consumer protection legislation, local state administrations, other executive authorities, local self-government bodies in accordance with the law, as well as courts.
In case of violation by LLC “AMC “Collective Investment Projects” of its obligations, it is necessary to contact the National Commission on Securities and Stock Market.
A consumer of financial services may apply to the NSSMC in accordance with the procedure provided by the Law of Ukraine “On Citizens’ Appeals”.
